Military Justice, Court Report Published Dec. 13, 2007 By 341st Space Wing Judge Advocate's Office MALMSTROM AIR FORCE BASE, Mont. -- The following individuals received non-judicial punishments during November. - An airman first class from the 341st Missile Security Forces Squadron received a suspended reduction to the rank of airman, a forfeiture of $150 pay per month for two months and 30 days extra duty for assaulting another airman. - A senior airman from the 341st Maintenance Operations Squadron received a reduction to the rank of airman first class and a suspended reduction to the rank of airman for failure to go and two specifications of failing to turn in required paperwork. - An airman first class from the 341st MSFS received restriction to base for 30 days and 30 days extra duty for underage drinking. - A senior airman from the 341st Logistics Readiness Squadron received a reduction to the rank of airman first class and a reprimand for failure to go. - An airman first class from the 10th Missile Squadron received a reduction to the rank of airman, a forfeiture of $100 pay and 21 days extra duty, suspended, for underage drinking and damaging government property. - An airman first class from the 341st Security Forces Squadron received a suspended reduction to the rank of airman, a forfeiture of $100 pay per month for two months and restriction to base for 14 days for sleeping while posted as a sentinel. - An airman first class from the 341st SFS received a suspended reduction to the rank of airman, a forfeiture of $100 pay per month for two months and restriction to base for 14 days for sleeping while posted as a sentinel. - An airman first class from the 341st SFS received a suspended reduction to the rank of airman, a forfeiture of $100 pay per month for two months and restriction to base for 14 days for sleeping while posted as a sentinel. - An airman first class from the 341st LRS received a suspended reduction to the rank of Airman, a forfeiture of $100 pay and a suspended forfeiture of $629 pay for driving a vehicle without proper registration. - An airman first class from the 341st Civil Engineer Squadron received a suspended forfeiture of $150 pay per month for two months, 30 days extra duty and a reprimand for failure to go and underage drinking. - An airman from the 341st MSFS received a reduction to the rank of airman basic, a suspended forfeiture of $650 pay per month for two months and restriction to base for 20 days for violating a no-contact order and communicating a threat to kill another airman. - A senior airman from the 341st SFS received a reduction to the rank of airman first class, a suspended forfeiture of $100 pay per month for two months and restriction to base for 60 days for failure to go, performing unauthorized duties, sleeping on duty, driving an uninsured vehicle and failing to make payments on a bank loan. - A staff sergeant from the 341st MOS received a suspended reduction to the rank of senior airman, a suspended forfeiture of $500 pay and 30 days extra duty for failing to obey an order to keep government quarters in inspection order. NOTE: Punishments may vary from Airman to Airman. When deciding on an appropriate level of punishment, commanders take into consideration the member's oral and written presentation, the member's duty performance and past history of misconduct, the need for good order and discipline, and the nature and circumstances of the offenses. GENERAL COURT-MARTIAL: Technical sergeant found guilty of conspiring to commit larceny, committing larceny of government property and false official statement. A general court-martial was held here Nov. 7 in the case of United States vs. Tech. Sgt. Charles D. Keen. Tech. Sgt. Charles Keen, a member of the 819th RED HORSE Squadron, was charged with one charge and two specifications of conspiring with a staff sergeant to commit larceny of more than $500 from the United States, in violation of Article 81, Universal Code of Military Justice, by arranging to use a government purchase card to purchase merchandise from Big R Stores, having those items returned in exchange for gift cards, and then using the gift cards for non-official, personal use. He was also charged with one charge and one specification of larceny of more than $500, in violation of Article 121, UCMJ, by wrongfully obtaining gift card credit and merchandise, the property of the United States. Finally, Sergeant Keen was charged with one charge and one specification of making a false official statement, in violation of Article 107, UCMJ, for certifying all the charges on his card holder's government purchase card were authorized, knowing such statement was false. At trial, Sergeant Keen pled guilty to all charges and specifications. After his guilty plea was accepted by the military judge, a five member officer panel sentenced Sergeant Keen to a reduction to the rank of Senior Airman, a $2,500 fine, 8 months confinement and a bad-conduct discharge.
