Military Justice Report May 2009 Published June 11, 2009 By Senior Airman Sarah Marlow 341st Missile Wing Judge Advocate Office MALMSTROM AIR FORCE BASE, Mont. -- The following individuals received non-judicial punishment in May: A staff sergeant from the 341st Civil Engineer Squadron received a suspended reduction to senior airman, 30 days extra duty and a reprimand for dereliction of duty by willfully failing to complete the required physical training workouts while enrolled in the Fitness Improvement Program. A senior airman from the 341st Logistics Readiness Squadron received a suspended reduction to airman first class, forfeitures of $250 pay per month for two months and a reprimand for dereliction of duty by willfully failing to refrain from consuming alcohol while under the age of 21 years old. An airman first class from the 341st LRS received a reduction to airman for failure to go at the time prescribed to an appointed place of duty and making a false official statement. A senior airman from the 341st Missile Security Forces Squadron received a reduction to airman first class, suspended forfeitures of $150 pay per month for two months, and 30 days extra duty for dereliction of duty by willfully failing to refrain from providing alcohol to individuals under the age of 21 years old. An airman first class from the 341st MSFS received forfeitures of $150 pay per month for two months and a reprimand for dereliction of duty by willfully failing to refrain from consuming alcohol while under the age of 21 years old. An airman first class from the 341st MSFS received a reduction to airman basic, forfeitures of $150 pay per month for two months, and 30 days extra duty for two specifications of failure to go at the time prescribed to an appointed place of duty and for wrongful use of marijuana. An airman first class from the 341st MSFS received a reduction to airman and suspended forfeitures of $150 pay per month for two months for two specifications of dereliction of duty by failing to comply with bay orderly duty restrictions. An airman first class from the 341st MSFS received a suspended reduction to airman, forfeitures of $150 pay per month for two months, and 15 days extra duty for being absent without leave from the unit. An airman from the 341st MSFS received a reduction to airman basic, suspended forfeitures of $150 pay per month for two months, and 30 days extra duty for dereliction of duties by willfully failing to immediately inform supervision of a PRP violation and wrongful use of marijuana. An airman from the 341st MSFS received a reduction to airman basic and 30 days extra duty for failing to go at the time prescribed to an appointed place of duty. A senior airman from the 341st Security Forces Squadron received a reduction to airman first class for failing to go at the time prescribed to an appointed place of duty. An airman first class from the 341st Security Support Squadron received a suspended reduction to airman, forfeiture of $200 pay per month for two months, 14 days extra duty and a reprimand for dereliction of duty by failing to correctly verify the dispatch status of a member. An airman first class from the 490th Missile Squadron received a reduction to airman basic, 14 days extra duty and a reprimand for failure to go at the time prescribed to an appointed place of duty; physically controlling a vehicle while drunk; and wrongful overindulgence in liquor or drugs resulting in incapacitation for the proper performance of duties. A senior airman from the 741st Missile Security Forces Squadron received a reduction to airman, 30 days extra duty and a reprimand for going from appointed place of duty; failing to go to at the time prescribed to an appointed place of duty; failing to maintain assigned government quarters within standards; and negligently failing to attend a follow-up medical evaluation. An airman first class from the 741st MSFS received a reduction to airman, restriction to base for five days, five days extra duty, and a reprimand for making a false official statement and larceny. A senior airman from the 819the RED HORSE Squadron received a reduction to airman basic, forfeitures of $699 pay per month for two months, 30 days extra duty and a reprimand for wrongful use of oxycodone, a Schedule II controlled substance. NOTE: Punishments may vary from Airman to Airman. When deciding on an appropriate level of punishment, commanders take into consideration the member's oral and written presentation, the member's duty performance and past history of misconduct, the need for good order and discipline, and the nature and circumstances of the offenses.
