Airman pleads guilty to wrongful use, possession and distribution of a controlled substance Published Dec. 18, 2009 By 341st Missile Wing Public Affairs Office MALMSTROM AIR FORCE, Mont. -- A special court-martial was held here on Oct. 7-8, in the case of United States v. Airman 1st Class Jonathon L. Searles. Airman Searles, a member of the 341st Missile Security Forces Squadron, was charged with three specifications in violation of Article 112a and two specifications in violation of Article 134, Uniform Code of Military Justice. Specifically, Airman Searles wrongfully possessed, used and distributed marijuana on multiple occasions. Additionally, Airman Searles wrongfully possessed and delivered drug paraphernalia, and wrongfully inhaled aerosol fumes while on duty, both of which were prejudicial to good order and discipline, and of a nature to bring discredit upon the armed forces. At trial, Airman Searles pled guilty to all charges and all specifications before a military judge, Col. David Castro. After Colonel Castro accepted Airman Searles' guilty plea, the sentencing phase of the trial began and evidence was presented to a panel of officer members to consider before they determined an appropriate sentence. After hearing all of the evidence, the members of the court sentenced Airman Searles to a bad conduct discharge, three months confinement, and forfeiture of $933 pay per month for six months. Airman Searles has the opportunity to submit matters to the special court-martial convening authority, Col. Michael Fortney, before the sentence is approved.
