Restriction is defined as preventing or attempting to prevent members of the Armed Forces from making or preparing to make lawful communications to an IG and/or Member of Congress. What rights do you have in communicating with an IG or Member of Congress? Under Title 10, United States Code, Section 1034, you have the right to access an IG or Member of Congress and their staff without notifying anyone in your supervisory channel. No person may restrict you from communicating with them. What are the consequences for violating these rights? Military members who limit or attempt to limit a person's access to an IG or Member of Congress are subject to persecution and/or disciplinary and administrative action under Article 92 of the UCMJ. DoD civilian employees (appropriated and nonappropriated fund) who violate this prohibition are subject to administrative or disciplinary action under Title 5, United States Code, Chapters 75 and 99 and DoD 1401.1-M, Personnel Policy Manual for Nonappropriated Fund Instrumentalities. What can you do if you become aware of restriction or believe you've been restricted in communicating with an IG or Member of Congress?
